These Terms of Service ("Terms") govern your access to and use of MessageAgent. By using the service, you agree to these Terms.

The service

MessageAgent is an omnichannel AI messaging service that helps you answer, qualify, book, upsell, and escalate customer conversations across channels such as SMS, WhatsApp, Instagram, Facebook Messenger, web chat, and email. Features and limits depend on your plan.

Your responsibilities

  • You are responsible for the content of conversations and for obtaining the consents required to message your customers, including TCPA consent for SMS and WhatsApp opt-in.
  • You will use the service lawfully and will not use it to send spam, deceptive, or prohibited content.
  • You will keep your account credentials secure.

AI disclosure and compliance

The service discloses that customers are interacting with an AI assistant and supports opt-out handling and human handoff. You remain responsible for your own legal and regulatory compliance. The service is not a substitute for licensed professional advice.

Billing

Paid plans are billed in advance on a monthly or annual basis in US dollars. Carrier and platform message fees are passed through at cost. Plans are month to month and you may cancel at any time; fees already paid are non-refundable except where required by law.

Availability

We work to keep the service reliable but do not guarantee uninterrupted availability. We may update or modify features over time.

Limitation of liability

To the extent permitted by law, MessageAgent is provided "as is", and we are not liable for indirect or consequential damages. Our total liability is limited to the amount you paid in the prior twelve months.

Changes

We may update these Terms. If we make material changes, we will take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.
